Common questions

Property transfers: frequently asked questions

Do I pay stamp duty if no money changes hands?

Possibly. Duty in Victoria is generally assessed on the greater of the price paid and the market value. Some exemptions exist, for example for certain transfers between spouses or under family law orders. We check eligibility before you transfer.

Does my lender need to agree?

If there is a mortgage on the property, yes. The lender usually needs to consent to a change in ownership or a refinance may be required.

Can you transfer property after separation?

Yes. We register transfers made under family law court orders or binding financial agreements, and can help with the family law side too.

Are there tax consequences?

A transfer can affect capital gains tax and land tax. We recommend speaking with your accountant before transferring.
