Common questions

Binding financial agreements: frequently asked questions

When can we make a financial agreement?

Before a marriage or de facto relationship, during it, or after separation.

Do both of us need a lawyer?

Yes. Each person must receive independent legal advice from their own lawyer before signing.

Can an agreement be set aside?

In some circumstances, for example fraud, non-disclosure or significant changes involving children. Careful drafting and full disclosure reduce the risk.

Is a financial agreement better than consent orders?

It depends. Consent orders are approved by the court; financial agreements are not. We explain which suits your situation.
