Divorce, handled clearly and calmly.

We prepare and file your divorce application, explain what happens next, and make sure property and parenting arrangements are dealt with too, because the divorce itself does not divide your property.

Common questions

Divorce: frequently asked questions

How long do we need to be separated?

At least 12 months before you apply. You can sometimes be separated while still living under the same roof, but extra evidence is needed.

We were married less than two years. Can we still divorce?

Yes, but you generally need to file a counselling certificate. If counselling is not possible, a different process applies. We will tell you which applies to you.

Does my spouse have to agree?

No. You can apply on your own (a sole application), and your spouse must be served with it. Or you can apply together.

Do I have to go to court?

Often not. Whether you need to attend the hearing depends on how the application was made and whether the other party asks to attend. We will tell you.

Does divorce sort out our property?

No. Property is dealt with separately, and there is a time limit: generally 12 months after the divorce becomes final.
